WASHINGTON — In a surprising move, President Donald Trump has announced his intention to nominate his personal criminal defense attorney, Emil Bove, for a lifetime federal judgeship on the U.S. Court of Appeals for the 3rd Circuit.

Bove, 44, previously served as a federal prosecutor in the Southern District of New York before transitioning to a private law firm in New Jersey. He was recruited by Todd Blanche, Trump’s deputy U.S. attorney general, to assist in defending Trump during his 2024 criminal indictment trial. Currently, Bove holds the position of principal associate deputy attorney general under Blanche.

During his tenure at the Justice Department, Bove has been accused of leveraging his role to target individuals perceived as political adversaries of Trump or to remove obstacles that could hinder Trump’s agenda, regardless of legal constraints. Notably, he orchestrated the transfer of senior career officials viewed as a safeguard against political interference within the department and ordered the dismissal of federal prosecutors involved in cases related to the January 6, 2021, insurrection at the U.S. Capitol.

Bove’s actions have raised significant concerns among legal experts and lawmakers. Carl Tobias, a law professor at the University of Richmond and an expert on federal judicial nominations, asserted that Bove’s conduct at the Justice Department alone should disqualify him from a lifetime appointment on the federal bench.

Senators Cory Booker (D-N.J.) and Andy Kim (D-N.J.) expressed deep reservations about Bove’s nomination, emphasizing the critical importance of judicial independence and objectivity. Progressive judicial advocacy groups have vehemently opposed Bove’s nomination, urging senators to reject his confirmation to the 3rd Circuit Court, which oversees cases in New Jersey, Delaware, and Pennsylvania.

Maggie Jo Buchanan, interim executive director of Demand Justice, condemned Bove’s nomination, stating that it is a reward for his unwavering loyalty to Trump. Caroline Ciccone, president of Accountable.US, a progressive watchdog group focused on government corruption, warned that Bove’s lifetime appointment could enable Trump and his allies to secure favorable rulings, irrespective of the constitutionality of their actions.

Trump’s initial batch of judicial nominees is scheduled for a hearing in the Senate Judiciary Committee, though a date for Bove’s nomination hearing has not yet been announced.
